<br />following terms and conditions that shall be observed by the applicant and any successor <br />in interest: <br /> <br />(a) Building construction shall be in general compliance with <br />the plans titled "Proposed Condominium Development for <br />the Oxford Building" and dated January 3, 2006, <br /> <br />(b) Exterior building construction and elevations shall be in <br />accordance with final plans submitted to and approved by <br />the Downtown Design Committee, <br /> <br />(c) No awnings shall be allowed on the tirst story, Awnings on <br />the second and third story shall be limited to five feet in <br />depth, <br /> <br />(d) The one-way traffic flow into and out of the parking area <br />shall enter on Queen Street and exit on Middle Street <br /> <br />(e) The developer shall be responsible for costs associated with <br />utility upgrades deemed necessary by the Director of Public <br />Utilities, including but not limited to possible water, sewer, <br />and/or storm water facilities for the community, <br /> <br />(f) rhe applicant shall comply with all applicable codes, <br />ordinances and regulations of federal, state and local <br />governments and shall obtain and maintain in effect all <br />required licenses and permits, <br /> <br />(g) All taxes owed on or in connection with the subject <br />property shall be paid in a timely manneL <br /> <br />3, EXPIRATION OF PERMIT: Unless extended as provided under <br />Section 40-115 of the Code of the City of Portsmouth, Virginia (1988), the group housing <br />use permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution, <br /> <br />4, REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the permit by the City CounciL <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on April 25, 2006, <br /> <br />Teste: <br /> <br />City Clerk <br />
