DECLARATION OF LOCAL EMERGENCY WHEREAS, at a meeting of the City Council of the City of Portsmouth, Virginia, held on October 24, 2006, a Resolution was passed authorizing the declaration of a local emergency in the City of Portsmouth, Virginia, due to property damage caused by Tropical Storm Ernesto, and WHEREAS, on August 31, 2006, Governor Kaine declared a state of emergency as a result of the anticipated destruction and damage from Tropical Storm Ernesto, and WHEREAS, Tropical Storm Ernesto passed through the City on August 31 and September I, 2006, and produced large quantities ofrain that caused major property damage reported by SPSA, located in Portsmouth, and damage reported by one other property owner, and WHEREAS, these claims were timely reported to the Virginia Department of Emergency Services (VDEM) by the Deputy Coordinator of Emergency Management for the City of Portsmouth, and VDEM requests a declaration of local emergency to assess the reported damage, and WHEREAS, Section 44-146.16 of the Code of Virginia, defines "emergency" to include an occurrence that results in substantial inj ury or harm to the population or substantial damage to or loss of property, and, a declaration of local emergency is needed for the government to deal effectively with this reported damage; NOW, THEREFORE, IT IS DECLARED, pursuant to the powers granted by Section 44-146.21 of the Code of Virginia, Section 2-656, et seq. of the Code of the Citv of Portsmouth. Virginia, and Article V of the Portsmouth Citv Charter, that a local emergency existed in the City of Portsmouth due to Tropical Storm Ernesto, and the powers, functions and duties of the Director of Emergency Management and the Emergency Management Agency shall be those prescribed by the laws of the Commonwealth and the ordinances of the City of Portsmouth.
