<br />DECLARATION OF LOCAL EMERGENCY <br /> <br />WHEREAS, at a meeting of the City Council of the City of Portsmouth, Virginia, <br />held on October 24, 2006, a Resolution was passed authorizing the declaration of a local <br />emergency in the City of Portsmouth, Virginia, due to property damage caused by <br />Tropical Storm Ernesto, and <br /> <br />WHEREAS, on August 31, 2006, Governor Kaine declared a state of emergency <br />as a result of the anticipated destruction and damage from Tropical Storm Ernesto, and <br /> <br />WHEREAS, Tropical Storm Ernesto passed through the City on August 31 and <br />September I, 2006, and produced large quantities ofrain that caused major property <br />damage reported by SPSA, located in Portsmouth, and damage reported by one other <br />property owner, and <br /> <br />WHEREAS, these claims were timely reported to the Virginia Department of <br />Emergency Services (VDEM) by the Deputy Coordinator of Emergency Management for <br />the City of Portsmouth, and VDEM requests a declaration of local emergency to assess <br />the reported damage, and <br /> <br />WHEREAS, Section 44-146.16 of the Code of Virginia, defines "emergency" to <br />include an occurrence that results in substantial inj ury or harm to the population or <br />substantial damage to or loss of property, and, a declaration of local emergency is needed <br />for the government to deal effectively with this reported damage; <br /> <br />NOW, THEREFORE, IT IS DECLARED, pursuant to the powers granted by <br />Section 44-146.21 of the Code of Virginia, Section 2-656, et seq. of the Code of the Citv <br />of Portsmouth. Virginia, and Article V of the Portsmouth Citv Charter, that a local <br />emergency existed in the City of Portsmouth due to Tropical Storm Ernesto, and the <br />powers, functions and duties of the Director of Emergency Management and the <br />Emergency Management Agency shall be those prescribed by the laws of the <br />Commonwealth and the ordinances of the City of Portsmouth. <br /> <br />James B.
