That the use permit is approved subject to the following conditions which shall be <br />observed by the applicant and any successor in interest: <br /> <br />(a) The center shall provide services for no more than 38 children. <br /> <br />(b) The age of the children shall be greater than 2 Y2 years, but less than <br />thirteen years of age. <br /> <br />(c) The center shall comply with the submitted site plan and floor plan. <br /> <br />(d) The days and hours of operation shall be Monday through Friday, 6:30 <br />a.m. to 6:00 p.m. <br /> <br />(e) The 2,116 square foot outdoor play area shall be enclosed with at least 4- <br />foot high fencing. <br /> <br />(I) The Downtown Design Committee shall approve the style of the outdoor <br />play area fencing. <br /> <br />(g) No more than 21 children may occupy the play area at anyone time. <br /> <br />(h) Outdoor play hours shall be between 8:00 a.m. and 6:00 p.m. <br /> <br />(i) Parking for instructors and the drop-off and pick-up of children shall take <br />place within the church parking lot. <br /> <br />Ul The applicant shall adhere to the Downtown D-2, 10% tree canopy <br />requirement. All planting of trees shall be completed prior to beginning <br />the operation of the day care center. <br /> <br />(k) The applicant shall provide a RPZ backflow preventer installed <br />downstream of the water meter as required by Public Utilities. <br /> <br />(1) The center shall submit to all required inspections and approvals obtained <br />by the City's Fire Department Bureau, Public Health Department and <br />Building Official. This shall include an initial inspection prior to the <br />opening of the center and annual inspections thereafter. <br /> <br />(m) The applicant shall comply with the Statewide Building Code. <br />
