<br />GROBE MO.t0_0\9-'9~ ~ <br /> <br />. <br /> <br />ZONING AMENDMENT ORDINANCE Z-05-14 <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning Ordinance which now zones as Commercial C-2, the property <br />described in Petition for Zoning Amendment Number Z-05-14, is hereby amended and <br />changed so as to show said property zoned as Residential RM-75-K (Conditional), and <br />that said property is hereby zoned as Residential RM-75-K (Conditional), <br /> <br />2. That the property affected by this ordinance by being zoned from <br />Commercial C-2 to Residential RM-75-K (Conditional), is furthermore described as <br />follows: <br /> <br />Z-05-14 <br /> <br />. <br /> <br />All that parcel of land currently numbered 3993 Twin Pines <br />Road and also known as PARCEL 2A TOWNE POINT PLAZA. <br />The property is further described as a parcel of land beginning at a <br />point 667.5 feet north of the northeast comer of the intersection of <br />Twin Pines Road and Gateway Drive, thence proceeding <br />N28032'24"E 72.01 feet, thence along the eastern line of Twin <br />Pines Road for a distance of 346.00 feet to a point, thence <br />S39021 '52"E 505.00 feet to a point, thenceS39035'15"W 150.32 <br />feet to a point, thence S28032'24"W 72.01 feet to a point, <br />thenceN61 027' 36"E 505 feet to the point of beginning. <br /> <br />3. That the subject property shall be subject to the following conditions as <br />proffered by the applicant for rezoning: <br /> <br />(a) The use of the property shall be limited to a condominium development <br />containing not more than six buildings with six units per building for a <br />total of 36 units. The site layout shall be substantially as shown on the <br />Twin Pines Condominiums Conceptual Plan dated September 28,2005, on <br />file in the City's Department of Planning. <br /> <br />(b) All units will have custom, no maintenance brick and vinyl exteriors with <br />designer-coordinated trim color. All structures shall be constructed <br />substantially in accordance with the approved elevations on file in the <br />City's Department of Planning. <br /> <br />(c) <br /> <br />A landscaping strip, at least ten feet in width and containing at least ten <br />street trees and 30 shrubs, will be provided and maintained along Twin <br />Pines Road. <br /> <br />. <br /> <br />
