<br />olUlllWl:E .2006-59 _ <br /> <br />AN ORDINANCE TO CLOSE A PORTION OF DORSET AVENUE. <br /> <br />WHEREAS, the Portsmouth Redevelopment and Housing Authority has requested the <br />closure of a portion of Dorset Avenue, as hereafter described; and <br /> <br />WHEREAS, the Planning Commission, at a meeting held on June 6, 2006, <br />recommended approval of the closure and vacation ofa portion of Dorset Avenue; and <br /> <br />WHEREAS, notice of the proposed closure and vacation has been given the adjoining <br />property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia that a portion of Dorset Avenue be closed and vacated as a public street and right of <br />way in the City of Portsmouth, Virginia, as follows: <br /> <br />DORSET AVENUE - All that portion of Dorset Avenue from its intersection <br />with the proposed eastern right of way line of Victory Boulevard to its point of <br />intersection with that portion of Dorset Avenue previously closed by Ordinance <br />Number 1998-40 of the Council of the City of Portsmouth, adopted on July 28, <br />1998, as shown on that certain exhibit attached hereto entitled "EXHIBIT <br />SHOWING PORTION OF DORSET AVENUE TO BE CLOSED AND <br />V ACA TED, PORTSMOUTH, VIRGINIA." <br /> <br />BE IT FURTHER ORDAINED that a 20' easement to Virginia Electric & Power <br />Company is hereby reserved across that portion of Dorset Avenue hereby closed and vacated for <br />the installation, operation, maintenance and replacement of electric utility facilities, which said <br />easement area of reservation is shown and designated on the aforementioned plat as "20' <br />EASEMENT RESERVED FOR VIRGINIA ELECTRIC AND POWER COMPANY." <br /> <br />BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves an <br />easement in the portion of Dorset Avenue hereby closed and vacated for the installation, <br />operation, maintenance and replacement of public utilities of the City of Portsmouth, Virginia, <br />which said easements may be released and vacated by the City Manager of the City of <br />Portsmouth as he may in his discretion deem appropriate and in the best interest ofthe City of <br />Portsmouth. <br /> <br />BE IT FURTHER ORDAINED, that the City Manager is hereby authorized to execute <br />a quitclaim deed or other documents as he may deem appropriate and necessary to convey any <br />rights the City may have in said closed street to such entity as may be required. <br />
