<br />ORDINANCE NO.2005-38
<br />
<br />AN ORDINANCE CLOSING AND VACATING PORTIONS OF BELMONT A VENUE,
<br />DeKALB AVENUE, BARCLA Y AVENUE, KIRBY STREET, APPOMATTOX A VENUE,
<br />BIDE-A-WEE LANE, DORSET AVENUE, INDEPENDENCE STREET, McLEAN
<br />STREET AND THE ENTIRE LENGTH OF SHADY LANE, GLEEP STREET, HALE
<br />COURT, NATHAN COURT, DeKALB COURT, AND GYGAX AVENUE.
<br />
<br />WHEREAS, the City of Portsmouth has requested the closure of a portion of Belmont
<br />Avenue, DeKalb Avenue, Barclay Avenue, Kirby Street, Appomattox Avenue, Bide-A-Wee
<br />Lane, Dorset Avenue, Independence Street, McLean Street and the entire length of Shady Lane,
<br />Gleep Street, Hale Court, Nathan Court, DeKalb Court, Belmont and Gygax Avenue, as hereafter
<br />described; and
<br />
<br />WHEREAS, the Planning Commission, at a meeting held on February 1,2005,
<br />recommended approval of the closure and vacation of a portion of Belmont Avenue, DeKalb
<br />Avenue, Barclay Avenue, Kirby Street, Appomattox Avenue, Bide-A-Wee Lane, Dorset Avenue,
<br />Independence Street, McLean Street and the entire length of Shady Lane, Gleep Street, Hale
<br />Court, Nathan Court, DeKalb Court, Belmont and Gygax Avenue; and
<br />
<br />WHEREAS, notice of the proposed closure and vacation has been given the adjoining
<br />property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended.
<br />
<br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth,
<br />Virginia that a portion of Belmont Avenue, DeKalb Avenue, Barclay Avenue, Kirby Street,
<br />Appomattox Avenue, Bide-A-Wee Lane, Dorset Avenue, Independence Street, McLean Street
<br />and the entire length of Shady Lane, Gleep Street, Hale Court, Nathan Court, DeKalb Court,
<br />Belmont and Gygax Avenue be closed and vacated as a public street and right of way, all as
<br />shown on an exhibit entitled "EXHIBIT SHOWING STREETS CLOSED AND V ACA TED IN
<br />THE AREA FORMERLY KNOWN AS FAIRWOOD HOMES", City of Portsmouth, Virginia,
<br />prepared by LandMark Design Group, dated May 10,2005, and to be recorded simultaneously
<br />with the Ordinance in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia,
<br />as follows:

<br />APPOMA TTOX AVENUE
<br />
<br />All that portion of Appomattox Avenue from its intersection with the eastern right of way
<br />line ofIndependence Street in an easterly direction to the western boundary of that property
<br />shown as South Highlands on the aforementioned exhibit, a distance of 192', more or less.
<br />
<br />BARCLAY A VENUE
<br />
<br />All that portion of Barclay Avenue from its intersection with the southern right of way
<br />line of DeKalb Avenue to the northern right of way line of Greenwood Drive and from the
<br />southern right of way line of Greenwood Drive in a southerly and easterly direction to the
<br />western boundary of that property shown as South Highlands on the aforementioned exhibit, a
<br />distance of 3,243', more or less.
