<br />. <br /> <br />. <br /> <br />. <br /> <br />Section 9.1-7. Required Conditions. <br /> <br />(c) A water quality impact assessment shall be required for any proposed <br />land disturbance within RP As and for any development within RMAs when required by <br />the City Engineer because of the unique characteristics of the site or intensity of <br />development, in accordance with the provisions of Section 9.1-1 I ill. <br /> <br />Section 9.1-9. Interpretation of Resource Protection Area Boundaries. <br /> <br />(a) Delineation by the Applicant. <br /> <br />The site-specific boundaries of the Resource Protection Area shall be determined <br />by the applicant through the performance of an environmental site assessment, subject to <br />approval by the Director of Planning and Zoning and in accordance with Section 9.1- <br />11 (b). A site-specific evaluation shall be conducted to determine whether water bodies on <br />or adjacent to the development site have perennial flow. The Chesapeake Bay <br />Preservation Area Map shall be used as a guide to the general location of Resource <br />Protection Areas. <br /> <br />(b) Delineation by the Director of Planning and Zoning. <br /> <br />The Director of Planning and Zoning, when requested by an applicant wishing to <br />construct a single-family residence, may waive the requirement for an environmental site <br />assessment and may perform the delineation. The Director of Planning and Zoning may <br />use remote sensing, hydrology, soils, plant species, and any other relevant data, and <br />consult other sources as needed to perform the delineation. The delineation of the <br />Director of Planning and Zoning shall be considered final and may not be appealed. <br /> <br />(c) Where Conflict Arises Over Delineation. <br /> <br />Where the applicant has provided a site-specific delineation of the RP A, the <br />Director of Planning and Zoning will verify the accuracy of the boundary delineation. In <br />determining the site-specific RPA boundary, the Director of Planning and Zoning may <br />render adjustments to the applicant's boundary delineation, in accordance with Section <br />9.1-11. In the event the adjusted boundary delineation is contested by the applicant, the <br />applicant may seek relief in accordance with the provisions of Section 9.1-11ill. <br /> <br />(d) Final Delineation Shown on CBP A Map. <br /> <br />When a delineation of a CBP A has been approved or established by the Director <br />of Planning and Zoning, the CBPA Map shall be amended to reflect that delineation. <br /> <br />Section 9.1-10. <br /> <br />Performance Standards. <br /> <br />(b) <br /> <br />General Performance Standards for Development and Redevelopment. <br />
