. . . ORDINANCE NO._2005-19 ZONING AMENDMENT ORDINANCE Z-05-01 BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That application has been made to amend the conditions pertaining to certain property that was zoned Residential RM-75-K (Conditional) by Ordinance No. 2003- 36, adopted by the City Council on May 27, 2003. 2. That the subject property is identified as Parcel B on the attached Exhibit A and its boundaries are unchanged from the property affected by Ordinance 2003-36. 3. That the following amended conditions as proffered by the applicant shall apply to the subject property from the date of adoption of this ordinance: Units shall be constructed as a "55 years and over" community pursuant to the provisions of the Federal Housing for Older Persons Act of 1995 and the Virginia Fair Housing Act. Density no greater than 8 units per acre. Sidewalks and walking trails required. Institute Master Architectural Review Board. Institute Building Materials/Standards. Single unit, duplex, triplex,Jour-plex buildings only Height restriction of no more than two stories. 95 % brick or stone; wood, hardy plank or vinyl may be used for architectural features. Wood, vinyl or aluminum only allowed on soffits and window frames. Only dimensional shingles on roof. Driveways must be colored or aggregate concrete or pavers; no asphalt, blacktop or white concrete. Only 3 styles of privacy fencing to be permitted of no more than 6 feet in height. Minimum square footage of 1200 square feet per unit. All units must have master suites on the first floor and a garage. 4. That this ordinance shall take effect on the date of its adoption.
