<br />" <br /> <br />Uj\uiHANCE 110- 200 ~'a 11...8 <br /> <br />. <br /> <br />AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 40-52.1(b) <br />THEREOF TO PERMIT LIMITED SOCIAL SERVICE ESTABLISHMENTS IN <br />THE OLDE TOWNE HISTORIC LIMITED OFFICE ZONING DISTRICT. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That Section 40-52,I(b) of the Code of the City of Portsmouth, Virginia <br />(1988) be amended and reordained to read as follows: <br /> <br />Sec. 40-52.1. Historic district; uses. <br />Permitted uses in the historic district shall be governed according to three (3) subdistricts, <br />as shown on the zoning map: <br /> <br />(b) Historic limited office. Permitted uses shall be limited to professional <br />offices, family care residences, as defined in section 40-22, single-family dwellings, and <br />accessory uses, as defined in section 40-22. Churches, schools, day-care centers, two- <br />family dwellings and multifamily dwellings shall be permitted only upon issuance of a <br />use permit, In the Olde Towne Historic District, bed and breakfast inns as provided for in <br />section 40-52,7 and limited service social establishments as defined herein shall be <br />permitted only upon issuance of a use permit. A combination of such residential and <br />professional office uses shall be permitted in the same building, provided that the <br />residential portion occupies not less than (50) percent of the floor area of the building. <br /> <br />. <br /> <br />For purposes of this section, a "limited service social establishment" shall mean <br />any establishment that: <br />i. Is owner-occupied; <br />ii. Is only open to one-time social events, such as teas, bridal showers, <br />receptions, etc.; <br />111. Admits guests by invitation only; <br />IV. Is not open to the general public; <br />v. Does not charge admission at the door; <br />VI. Utilizes background music only from a stereo system or a mUSICIan <br />employing only one amplified instrument, provided that any mUSIC <br />produced may not be audible beyond the subject property; <br />V11. Limits attendance to no more than 48 guests; <br />Vlll. Utilizes only food and beverages prepared off-site; provided, however, <br />that the warming or chilling of food and beverages on-site is permitted. <br />IX. Hosts outdoor events only if allowed by use permit; <br />x. Serves alcoholic beverages pursuant to a one-time banquet license secured <br />by a person other than the operator of the establishment; and <br />Xl. Provides one parking space for every four guests. <br />A limited service social establishment may not be employed for regular meetings. <br />Signage shall be limited to one wall sign not to exceed four square feet. Such sign shall <br />not be illuminated and shall meet all zoning requirements including approval by the <br />commission of architectural review, <br /> <br />. <br /> <br />
