<br />. <br /> <br />the Plan-approving authority does not approve a variance within 10 days of receipt of <br />the request, the request shall be considered to be disapproved. Following disapproval, <br />the applicant may resubmit a variance request with additional documentation. <br /> <br />(iii) <br /> <br />The Plan-approving authority shall consider variance requests judiciously, keeping in <br />mind both the need of the applicant to maximize cost effectiveness and the need to <br />protect off-site properties and resources from damage. <br /> <br />2. That Article 3 of the Chapter 11 of the Code of the City of Portsmouth, Virginia <br />(1988) be renumbered as Article 2. <br /> <br />3. That new sections 11.1-7 and 11.1-8 be adopted as part of Chapter 11.1 of the Code <br />of the City of Portsmouth, Virginia (1988) to read as follows: <br /> <br />Sec. 11.1-7. Permit fee required for land-disturbing activities. <br /> <br />An applicant for a land-disturbing permit pursuant to the requirements of Chapter 11 <br />shall pay the following fee for the cost of processing and issuing the per <br /> <br />(1) Development of an individual single-family lot involving over 2,500 square feet <br />of land disturbance.. .$50.00 <br /> <br />. <br /> <br />(2) <br /> <br />Multifamily development, subdivisions, and nonresidential development <br />involving one acre or less...50.00 <br /> <br />(3) Multifamily development, subdivisions, and nonresidential development <br />involving more than one acre.. .50.00 <br /> <br />(4) Plus, for each additional acre or portion thereof.. .35.00 <br /> <br />. <br /> <br />Sec. 11.1-8. Fee; number of copies; contents. <br /> <br />A fee of$75.00 shall accompany an erosion and sedimentation control plan at the time of <br />submission pursuant to the requirements of Chapter 11. If the plan is submitted in conjunction <br />with a commercial or industrial site plan review, no fee shall be charged under this section. In <br />addition, no fee shall be charged under this section for review of an erosion and sedimentation <br />control plan for the development of an individual single-family residential lot. Three copies of <br />the erosion and sedimentation control plan, along with a topographic survey and a plan showing <br />the proposed development use, including but not limited to, subdivision, group housing project, <br />commercial or industrial development, condominium or planned unit development, shall be <br />submitted to the plan-approving authority. The plan shall include all information required by the <br />handbook referred to in section 11-3 and required for subdivision preliminary layouts by the <br />subdivision ordinances, excluding commercial and industrial developments.
