<br />t) ~\ LHNANCE KfJ. 20 o.s. ~~. <br /> <br />. <br /> <br />AN ORDINANCE TO AMEND CHAPTERS 11 AND 11.1 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA BY REPEALING ARTICLES 1 AND 2 OF CHAPTER 11 AND <br />BY ADOPTING A NEW ARTICLE 1 THERETO AND BY ADOPTING NEW SECTIONS <br />11.1-7 AND 11.1-8 PERTAINING TO EROSION AND SEDIMENT CONTROL. <br /> <br />BE IT ORDAINED by the Council ofthe City of Portsmouth, Virginia: <br /> <br />1. That Articles 1 and 2 of Chapter 11 of the Code of the City of Portsmouth, Virginia <br />be repealed and that a new Article 1 be adopted to read as follows: <br /> <br />Chapter 11. EROSION AND SEDIMENT CONTROL; EXCAVATION <br /> <br />ARTICLE I. EROSION AND SEDIMENT CONTROL <br /> <br />Section 11-1. Title and purpose. <br /> <br />This article shall be known as the "Erosion and Sediment Control Ordinance ofthe City of <br />Portsmouth." The purpose of the article is to prevent degradation of properties, stream channels, <br />waters and other natural resources of the City of Portsmouth by establishing requirements for the <br />control of soil erosion, sediment deposition and nonagricultural runoff and by establishing <br />. procedures whereby these requirements shall be administered and enforced. <br /> <br />Section 11-2. Definitions. <br /> <br />As used in the ordinance, unless the context requires a different meaning: <br /> <br />"Agreement in lieu of a plan" means a contract between the Plan-approving authority and the <br />owner that specifies conservation measures that must be implemented in the construction of a single- <br />family residence; this contract may be executed by the Plan-approving authority in lieu of a formal <br />site plan. <br /> <br />"Applicant" means any person submitting an erosion and sediment control plan for approval <br />or requesting the issuance of a permit, when required, authorizing land-disturbing activities to <br />commence. <br /> <br />"Board" means the Virginia Soil and Water Conservation Board. <br /> <br />"Certified inspector" means an employee or agent of a program authority who (i) holds a <br />certificate of competence from the Board in the area of project inspection or (ii) is enrolled in the <br />Board's training program for project inspection and successfully completes such program within one <br />year after enrollment. <br /> <br />. <br /> <br />
