AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 30-100 AND 30-221 THEREOF TO REMOVE THE TIME LIMIT FOR PURCHASING CREDITABLE VIRGINIA RETIREMENT SYSTEM SERVICE FOR EMPLOYED MEMBERS OF THE PORTSMOUTH SUPPLEMENTAL RETIREMENT SYSTEM AND THE PORTSMOUTH FIRE AND POLICE RETIREMENT SYSTEM. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Sections 30-100 and 30-221 of the Code of the City of Portsmouth, Virginia (1988) be amended and reordained to read as follows: Sec. 30-100. Inclusion of service under the Virginia Retirement System. . With respect to any member who is employed full-time by the City of Portsmouth at the time of making application hereunder for service credits and who was a member of the former Virginia Supplemental Retirement System, currently the Virginia Retirement System, immediately prior to his becoming a member of this system, and whose membership in the Virginia Retirement System has ceased through withdrawal of his contributions thereunder, the period oftime during which he was a member of the Virginia Retirement System shall be included as creditable service hereunder, provided he terminates his membership in said system and pays into the retirement system an actuarially determined amount deemed to be correct and neutral by the Retirement Board with regard to funding the projected additional retirement allowance to be received by the member through the purchase of such additional service credit. Such amount paid into the retirement system by the member under the provisions of this section shall remain as assets of the retirement system and shall not be considered as employee contributions, any other provisions of this article to the contrary notwithstanding.
