<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />direction 120 feet to a point; thence in a westerly direction <br />134 feet to the point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) The applicant shall provide a minimum of 10 on-site parking spaces. <br /> <br />(b) A maximum of two (2) delivery pick-ups will occur between the hours of <br />2 a.m. and 8 a.m. <br /> <br />(c) The hours of operation shall be from 6:00 p.m. to 8:00 a.m., seven (7) <br />days a week. <br /> <br />(d) The storage/removal of trash shall be in accordance with the Waste <br />Management Plan approved by General Services on March 2, 2005 <br /> <br />(e) The applicant shall submit to all required inspections by the City's Fire <br />Prevention Bureau, Public Health Department and Building Official. This <br />shall include an initial inspection prior to the opening of the business and <br />annual inspections thereafter. <br /> <br />(f) <br /> <br />The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local goverrunents and shall obtain and <br />maintain all necessary licenses and permits. <br /> <br />(g) All taxes and fees owed or collected in connection with the subject <br />property and operations shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at meeting held <br />on June 14,2005. <br /> <br />Teste: <br /> <br />City Clerk <br />
