<br />R-OS-S8 <br /> <br />. <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO <br />MUTUAL AID AGREEMENTS, INCLUDING INTERGOVERNMENTAL <br />AGREEMENTS, IN RESPONSE TO REQUESTS FROM STATES IMPACTED <br />BY DISASTERS, SUCH AS HURRICANES KA TRINA AND RITA. <br /> <br />WHEREAS, the Virginia Department of Emergency Management (VDEM) <br />coordinates interstate mutual aid requests from other states through the Emergency <br />Management Assistance Compact (EMAC), adopted under Virginia Code Sections 44- <br />146.14 and 44-146.28; and <br /> <br />WHEREAS, on August 31, 2005, Governor Mark R. Warner issued Executive <br />Order 97 (2005) in support of the EMAC to assist the states of Louisiana, Mississippi, <br />and Alabama, as a result of Hurricane Katrina, which Order was subsequently extended <br />to address the effects of Hurricane Rita; and <br /> <br />WHEREAS, VDEM has requested that the City of Portsmouth lend the services <br />of certain City employees and equipment to assist in the recovery efforts in states directly <br />affected by the storms; and <br /> <br />WHEREAS, the City Manager from time to time is required to execute <br />intergovernmental agreements to allow the use of Portsmouth personnel and equipment <br />resources to assist in the rescue, recovery, and other efforts in declared emergencies, such <br />as Hurricanes Katrina and Rita; and <br /> <br />. WHEREAS, a grant of authority to the City Manager to execute <br />intergovernmental agreements as authorized by Executive Order of the Governor and the <br />VDEM/EMAC process in times of declared emergencies will expedite the process of <br />assisting other governments during their times of need. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that the City Manager be, and he hereby is, authorized to execute <br />intergovernmental agreements as authorized by Executive Order of the Governor and the <br />VDEMIEMAC process as a result of Hurricanes Katrina and Rita. <br /> <br />BE IT FURTHER RESOLVED that authority to execute intergovernmental <br />agreements authorized by Executive Order of the Governor and the VDEMIEMAC process be, <br />and hereby is, granted to the City Manager in order to address subsequent events of <br />declared emergencies. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on October 11,2005. <br /> <br />Teste: <br /> <br />. <br /> <br />City Clerk <br /> <br />
