<br />R-05-09 <br /> <br />A RESOLUTION APPROVING THE 2006 ACTION PLAN OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, AND AUTHORIZING THE CITY MANAGER TO FILE <br />DOCUMENTS REQUIRED TO OBTAIN THE CITY'S 2006 COMMUNITY PLANNING <br />AND DEVELOPMENT GRANT ENTITLEMENTS. <br /> <br />. <br /> <br />WHEREAS, pursuant to the Housing and Community Development Act of 1974, as <br />amended, and the Cranston - Gonzalez National Affordable Housing Act of 1992, as amended, <br />("Acts"), financial assistance is provided to enable localities to provide decent housing, establish <br />and maintain suitable living environments, and expand economic opportunities for low to <br />moderate income residents; and <br /> <br />WHEREAS, each of the three community planning and development programs <br />(Community Development Block Grant, HOME, and the Emergency Shelter Grant) shall be <br />operated on a single consolidated program year ("Action Plan"); and <br /> <br />WHEREAS, the required public hearing has been held and the City Council has <br />reviewed the proposed 2006 Action Plan's Statement of Objectives and Use of Funds; and <br /> <br />WHEREAS, it is necessary that this Council take official action regarding the 2006 <br />Action Plan to comply with the regulations of the aforementioned Acts; and <br /> <br />WHEREAS, this Council is aware of the federal regulations governing the undertaking <br />and carrying out of activities under the Consolidated Plan Program; and <br /> <br />. WHEREAS, this Council recognizes its responsibility to direct that safeguards be <br />established to protect employees from using their positions for a purpose that gives the <br />appearance of being motivated by a desire for private gain for themselves or others, particularly <br />those with whom they have family, business or other ties; and <br /> <br />WHEREAS, this Council has found that the use of Funds for the 2006 Action Plan is <br />appropriate to meet the needs of the City and, therefore, are acceptable. <br /> <br />NOW THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia, that the 2006 Action Plan's Proposed Statement of Objectives and use of Funds having <br />been reviewed and considered, said plans be and hereby are approved as final in all respects, and <br />the City Manager is hereby authorized to file the Final Statement of Objectives and use of Funds <br />and any additional information as may be required with the Department of Housing and Urban <br />Development in order to obtain funding for the Program. <br /> <br />BE IT FURTHER RESOLVED that the City Manager is designated as the certifying <br />officer and authorized representative of the City of Portsmouth and shall provide assurances as <br />required of the locality by the Acts for the approval of the Program. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />March 22,2005. <br /> <br />. <br /> <br />Teste: <br /> <br />City Clerk <br />
