(c) <br /> <br />(d) <br /> <br />(e) <br /> <br />(0 <br /> <br />(g) <br /> <br />(h) <br /> <br />(i) <br /> <br />(J) <br /> <br />A landscaping plan, developed by the applicant, must be submitted for <br />review and approval to the Director of Planning and Zoning. A landscaped <br />buffer meeting the requirements of Landscaping Group 2 shall be <br />established and maintained along the western and southern property lines. <br />The Director of Planning and Zoning must also approve any modification <br />to the approved landscaping plan. <br /> <br />Street lighting with high pressure sodium fixtures shall be provided along <br />the proposed street (Empire Court) in accordance with Illumination <br />Engineer Standards for Roadways. A lighting plan for the development <br />must be approved by the Department of Public Works prior to issuance of <br />any building permits. <br /> <br />The applicant shall be responsible for the cost and upgrading of utilities <br />for this development and shall coordinate with Director of Public Utilities <br />on design of the sewer line. <br /> <br />Any revisions to the site plan or landscaping plan or elevations made <br />through the group housing application process, including any changes by <br />City Council, must be submitted to the Director of Planning and Zoning <br />for approval prior to issuance of building permit. <br /> <br />The driveway to each unit shall be paved to a maximum width of ten feet. <br />The applicant shall ensure that the remaining area shall be landscaped. <br />Parking restrictions in this area shall be controlled through deed <br />restriction. <br /> <br />The applicant shall provide a recreational play area as identified on the site <br />plan. <br /> <br />The applicant shall comply with all regulations of federal, state and local <br />governments. <br /> <br />All taxes and fees owed in connection with the property shall be paid <br />when due. <br /> <br /> 2. EXPIRATION OF PERMIT: Unless extended as provided under <br />Section 40-115 of the Code of the City of Portsmouth, Virginia (1988), the group housing <br />use permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br /> 3. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the permit by the City Council. <br /> <br /> <br />
