That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) <br /> <br />The applicant shall provide a minimum of 24 parking spaces for the eating <br />place. <br /> <br />(b) The seating capacity of the eating place shall be limited to 75. <br /> <br />(c) <br /> <br />The hours of operation shall be from 7:00 a.m. to 4:00 p.m., Monday <br />through Saturday. <br /> <br />(d) <br /> <br />The applicant shall submit a site plan to the City Engineer showing <br />landscaping and parking spaces that meet parking standards. <br /> <br />(e) <br /> <br />The storage/removal of trash shall be in accordance with the waste <br />management plan approved by the Department of General Services on <br />May 20, 2004. <br /> <br />The applicant shall submit to all required inspections by the City's Fire <br />Prevention Bureau, the Public Health Department and the Building <br />Official. This shall include an initial inspection prior to the opening of the <br />business and annual inspections thereafter. <br /> <br />(g) <br /> <br />The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and <br />maintain all necessary licenses and permits. <br /> <br />(h) <br /> <br />All taxes and fees owed or collected in connection with the subject <br />property and operations shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia, at meeting held <br />on July 27, 2004. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
