R-04-37 <br /> <br />A RESOLUTION AUTHORIZING THE EXPENDITURE OF ADDITIONAL <br />FUNDS FOR REPLACEMENT OF NTELOS PERFORMING ARTS CENTER <br />ROOF. <br /> <br /> WHEREAS, on November 25, 2003, the City Council authorized the execution <br />of a contract in the amount of $1,511,000 with SPAN Systems for replacement of the <br />Ntelos Performing Arts Center roof that was damaged during Hurricane Isabel in <br />September 2003; and <br /> <br /> WHEREAS, the Portsmouth City Code provides that no fixed price contract may <br />be increased by more than $50,000 or 25%, whichever is greater, without the approval of <br />City Council; and <br /> <br /> WHEREAS, City Council on June 8, 2004, appropriated the amount of $2.5 <br />million for the total repairs to the Ntelos facility; and <br /> <br /> WHEREAS, unforeseen design and construction conditions will result in an <br />increase to the City's contract with SPAN Systems of more than 25%. <br /> <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that it hereby approves the additional expenditure of appropriated <br />funds exceeding 25% of the original contract amount with SPAN Systems, and the City <br />Manager is authorized to approve such expenditures, as he deems necessary and <br />appropriate. <br /> <br />This resolution shall take effect on the date of its adoption. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on June 22, 2004. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
