R-04-32 <br /> <br />A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING WITH <br />TIDEWATER COMMUNITY COLLEGE AND OTHER PARTIES. <br /> <br /> WHEREAS, the City did on January 15, 2002 adOpt a resolution in support of a new <br />Tidewater Community College ("TCC") campus at the then-planned Victory Crossing <br />Commerce Park; and <br /> <br /> WHEREAS, the City has now reached agreement with Victory Crossing Developers, <br />LLC (the "Developer") to develop Victory Crossing, and a legally binding development <br />agreement has been signed by thOse parties; and <br /> <br /> WHEREAS, TCC needs a moral commitment of the City to go forward with <br />development of that new campus, with the City bearing all appropriate costs of site development, <br />in order for TCC to obtain timely approvals from the State Board for Community Colleges (the <br />"State Board"), and also in order for TCC to coordinate planning for the new campus with the <br />Developer; and <br /> <br /> WHEREAS, it is inthe interest 0fthe City and its citizens, as wei1 as TCC and the <br />Commonwealth, to reach prompt agreement and commitment in principle with TCC, the <br />Developer, and the State Board about both construction of the contemPlated new campus, and <br />also future expansions of the campus, and for the City to give a moral obligation to that end; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia, that the City Manager, acting for and on behalf of the City, is hereby authorized to <br />execute a Memorandum of Understanding with TCC, the Developer, and the State Board <br />substantially the same as that which is attached to this resolution. <br /> <br /> Adopted by the COuncil of the City of Portsmouth, Virginia, at a meeting held on June 8, <br />2004. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
