R-04-53 <br /> <br />A RESOLUTION AUTHORIZING THE EXPENDITURE OF FUNDS IN EXCESS <br />OF 25% OF $689,879.01 FOR IMPROVEMENTS TO LEE AND VIRGINIA <br />AVENUES. <br /> <br /> WHEREAS, the City of Portsmouth entered into and has been administering a <br />contract for improvements to Lee and Virginia Avenues; and <br /> <br /> WHEREAS, unanticipated utility conflicts will cause the construction project to <br />exceed the contract amount of $689,876.01 by more than 25%; and <br /> <br /> WHEREAS, City Code section 12-183 requires that City Council authorize any <br />increase to a contract in excess of 25% of the original contract amount; and <br /> <br /> WHEREAS, the project is completely funded by the Virginia Department of <br />Transportation (VDOT), and no City match required; and <br /> <br />WHEREAS, VDOT has already approved the increase in the project cost. <br /> <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that it hereby authorizes the expenditure of funds exceeding by 25% <br />the originally contracted amount for improvements to Lee and Virginia Avenues. <br /> <br /> BE IT FURTHER RESOLVED that this resolution shall take effect on the date <br />of its adoption. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on October 26, 2004. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
