Section 9.1-6. Lot Size. <br /> <br /> Lot size shall be subject to the reqnirements of the underlying zoning district(s), <br />provided that any lot shall have sufficient area outside the RPA to accommodate an <br />intended development, in accordance with the performance standards in Section 9.1-10, <br />when such development is not otherwise allowed in the RPA. <br /> <br />Section 9.1-7. Required Conditions. <br /> <br /> (a) All development and redevelopmem exceeding 2,500 square feet of land <br />disturbance shall be subject to a plan of development process, including the approval of a <br />site plan in accordance with the provisions of the Zoning Ordinance or a subdivision plat <br />in accordance with Chapter 33. <br /> <br /> (b) The City of Portsmouth may allow development in R_PAs upon approval <br />only i£ it: (i) is water-dependent; or (ii) constitutes redevelopment. <br /> <br /> (c) A water quality impact assessment shall be required for any proposed <br />development or redevelopment within RPAs and for any development within RMAs <br />when required by the City Engineer because of the unique characteristics of the site or <br />intensity of development, in accordance with the provisions of Section 9.1-11. <br /> <br />Section 9.1-8. Conflict with other Regulations. <br /> <br /> In any case where the requirements of this Chapter conflict with any other <br />provision of the Code of the City of Portsmouth or existing state or federal regulations, <br />whichever imposes the more stringent restrictions shall apply. <br /> <br />Section 9.1-9. Interpretation of Resource Protection Area Boundaries. <br /> <br /> (a) Delineation by the Applicant. <br /> <br /> The site-specific boundaries of the Resource Protection Area shall be determined <br />by the applicant through the performance of an environmental site assessment, subject to <br />approval by the Director of Planning and Zoning and in accordance with Section 9.1-1 I. <br />A site-specific evaluation shall be conducted to determine whether water bodies on or <br />adjacent to the development site have perennial flow. The Chesapeake Bay Preservation <br />Area Map shall be used as a guide to the general location of Resource Protection Areas. <br /> <br /> (b) Delineation by the Director of Planning and Zoning. <br /> <br /> The Director of Planning and Zoning, when requested by an applicant wishing to <br />construct a single-family residence, may waive the requirement for an environmental site <br />assessment and may perform the delineation. The Director of Planning and Zoning may <br />use remote sensing, hydrology, soils, plant species, and any other relevant data, and <br /> <br /> <br />
