ORDIHANCE <br /> <br />AN ORDINANCE TO AMEND CHAPTERS 27 AND 37 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA BY AMENDING SECTIONS 27-6, AND <br />37-100 THEREOF AND BY ENACTING A NEW SECTION 27-7 PERTAINING <br />TO FALSE ALARMS, TRUCKING PERMITS, AND MISCELLANEOUS FEES <br />FOR POLICE ADMINISTRATIVE SERVICES AND DOCUMENT COPIES. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Sections 27-6 and 37-100 of the Code of the City of Portsmouth, <br />Virginia (1988) be amended and reordained to read as follows: <br /> <br />Sec. 27-6. False alarms of criminal activities. <br /> <br /> (c) No service charge shall be imposed upon the first occurrence of a false <br />alarm. A service charge of ($35.00) shall be imposed for a second false alarm occurrence, <br />$50.00 for third and fourth occurrences, $75.00 for fifth through ninth occurrences, and <br />$100.00 for subsequent occurrences within a twelve month period; except that where it is <br />demonstrated to the chief of police that a false alarm was generated by adverse weather <br />conditions, electrical or telephonic power failures, and other causes, including equipment <br />malfunctions, not resulting from the negligence of the alarm user, his agents and <br />employees, a service charge shall not be assessed. The service charge shall be payable <br />within five (5) days of written notification to the alarm user of the assessment. <br /> <br />Sec. 37-100. Replacement when lost, stolen or destroyed. <br /> <br /> Any public vehicle driver's permit issued under this division which has been lost, <br />stolen or destroyed may be replaced by the chief of police upon application by the <br />permittee for a replacement permit in the same manner as is required under section 37-92, <br />and upon the payment of a replacement fee of $10.00. In addition to the information <br />required by section 37-92, the application shall include a sworn statement setting forth <br />the facts surrounding the loss, theft or destruction. Any such replacement permit shall be <br />issued only for the remainder of the term of the lost permit. Upon the issuance ora <br />replacement permit, the lost, stolen or destroyed permit shall be deemed canceled, and a <br />notation of such cancellation shall be entered on the appropriate records. <br /> <br /> 2. That a new Section 27-7 of the Code of the City of Portsmouth, Virginia <br />be adopted to read as follows: <br /> <br />Sec. 27-7.
