ORDINANCE NO. 2004-10 <br /> <br />ORDINANCE TO AMEND CHAPTER 31.1 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 31.1-1 AND 31.1-3 <br />THEREOF PERTAINING TO STORMWATER MANAGEMENT. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Section 31.1-1 of the Code of the City of Portsmouth, Virginia be amended <br />by the addition of a new defimtion entitled "Process water" to read as follows: <br /> <br />Sec. 31.1-1. Definitions. <br /> <br /> Process water means water used in a commercial, industrial, manufacturing or processing <br />operation and which comes in contact with materials used in that operation or with the end <br />product of the operation. <br /> <br /> 2. That Section 31.1-3 of the Code of the City of Portsmouth, Virginia (1988) be <br />amended and reordained to read as follows: <br /> <br />Sec. 31.1-3. Pollution of the stormwater system. <br /> <br /> (a) Prohibited acts: <br /> <br /> (1) It shall be unlawful for any person to put, or allow to be put, any process water, <br /> waste water, filth, animal or vegetable matter, chips, shavings or any other <br /> substance in the stormwater system, or do any injury thereto, or in any manner <br /> pollute the stormwater system. <br /> <br /> (2) It shall be unlawful for any person to pour or discharge, or to permit to be poured <br /> or discharged, or to deposit, so that the same may be discharged, any gasoline, oil <br /> waste, antifreeze, or other fluids from vehicles or motor vehicles or equipment <br /> into any stormwater system. <br /> <br /> (3) It shall be unlawful for any commemial, industrial or manufacturing entity to <br /> discharge process water or unpermitted discharge into any stormwater system. <br /> <br /> (4) It shall be unlawful for any person to throw, place or deposit, or cause to be <br /> thrown, placed or deposited, in any gutter, ditch, storm drain or other drainage <br /> area in the city anything that impedes or interferes with the free flow of <br /> stormwater therein. <br /> <br /> (b) Penalty for violation. Unless otherwise specified, any person or entity who shall <br />violate any of the provisions of this chapter, or any regulation promulgated pursuant to authority <br />granted by this chapter, shall be guilty of a misdemeanor and shall be subject to a fine not <br />exceeding $1,000.00 or up to thirty days imprisonment for each violation or by both fine and <br />imprisonment.
