ZONING AMENDMENT ORDINANCE Z-02-12 <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virgima: <br /> <br /> 1. That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning Ordinance which now zones as Residential RS-75, the property <br />described in Petition for Zoning Amendment Number Z-02-12, is hereby amended and <br />changed so as to show said property zoned as Commercial C-1-K (Conditional), and that <br />said property is hereby zoned as Commercial C-1-K (Conditional). <br /> <br /> 2. That the property affected by this ordinance by being zoned from <br />Residential RS-75 to Commercial C-1-K (Conditional) is furthermore described as <br />follows: <br /> <br /> Z-02-12 <br /> <br /> Beginning on the south side of Portsmouth <br /> Boulevard approximately 525' from its intersection with <br /> Elmhurst Lane; thence west along the south right-of-way of <br /> Portsmouth Boulevard approximately 425" to a point; <br /> thence south 160'; thence southeasterly 242'; thence <br /> southerly approximately 115'; thence east approximately <br /> 124', thence northerly approximately 335' to Portsmouth <br /> Boulevard, the point of origin. <br /> <br /> 3. That the subject property shall be subject to the following conditions as <br />proffered by the applicant for rezoning: <br /> <br /> (a) Use of the property shall be limited to eating places, general <br /> merchandise stores, depository institutions, msurance agents, broker services, and <br /> real estate. <br /> <br /> (b) Landscaping Group 1 shall be provided along the western edge of <br /> the property line, adjacent to residential zoning. <br /> <br /> (c) The existing tree line along the southern property line shall remain <br /> for buffering and screening purposes. <br /> <br /> (d) A maximum sound pressure level shall be 67 dB(al between 7 a.m. <br /> and 10 p.m. and 62 dB(a) between 10 p.m. and 7 a.m. as set forth in Section 24- <br /> 255 (20)(d) of the City Code. <br /> <br /> (e) A maximum of three (3) curb cuts will be permitted along <br /> Portsmouth Boulevard. <br /> <br /> <br />
