That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in intorest: <br /> <br />(a) <br /> <br />The hours of operation shall be limited to 8 a.m. to 6 p.m. Monday <br />through Friday and 9 a.m. to noon on Saturday. <br /> <br />(b) <br /> <br />All exterior modificatiOns shall be reviewed and approved by the <br />Downtown Design Committee. <br /> <br />(c) <br /> <br />The drive-thru window On the exterior of the building shall be removed <br />before occupying the building. <br /> <br />(d) <br /> <br />A landscaping plan must be submitted and approved by the Department of <br />Planning and Zoning. <br /> <br />(e) <br /> <br />The applicant shall complY with the trash/garbage plan approved by the <br />Director of the Department of General Services. <br /> <br />(f) <br /> <br />The applicant shall provide a minimum of sixteen off-street parldng <br />spaces. <br /> <br />(g) <br /> <br />All taxes and fees owed or collected in connection with the subject <br />property and operation shall be paid when due. <br /> <br />(h) <br /> <br />The applicant and any successor in interest shall comply with all <br />applicable statutes, ordinances and regulations of federal, state and local <br />governments shall obtain and maintain in effect all required permits. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use pm'mit by the City Council. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virgima, at meeting held <br />on September 23, 2003. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
