Pursuant to the F~a. Code 44-146.17 and Executive Order Fifty- <br />six (03) of Governor Mark R. Warner, and for the purpose of protecting <br />public safety and preserving public order, I hereby declare and order an <br />EVACUATION CURFEW (the "Curfew") as follows: <br /> <br />1. The Curfew shall be effective immediately, in all areas of the City. It <br /> shall remain in effect for fourteen days, unless sooner rescinded or <br /> modified by me or by Portsmouth City Council. <br /> <br />The hours of the Curfew shall be between 7:00PM and 7:00AM (the <br />"Curfew Period"). <br /> <br />It shall be unlawful for any person to be on any public street or in any <br />public way, or in any commercial parking lot or shopping area during <br />the Curfew period, unless for one of the exceptions listed herein. <br /> <br />4. The exceptions to the Curfew shall be as follows: <br /> <br />Any law enforcement officer, fire/EMS official, member of the <br />National Guard, member of any branch of the military service <br />of the United States, physician, or health care professional who <br />is engaged in the official performance of duty, or who is going <br />to or from any destination to commence or return from the <br />official performance of duty. <br />Any person going to or from work, or engaged in the <br />performance of his or her normal work, trade, or occupation. <br />Any person engaged in' helping any other person w~th a medical <br />emergency. <br /> <br />o <br /> <br />A person observed to be in violation of the Curfew who claims to be <br />within one of said exceptions shall have the burden of so proving. <br /> <br />o <br /> <br />If a law enforcement officer observes any person in violation of the <br />Curfew, the officer shall inform the person of the Curfew and order <br />him or her to return home the most direct route.
