An environmental compliance excavation permit issued pursuant to this article <br />shall include the following terms and conditions: <br /> <br /> (2) All excavation activities shall be conducted in a manner which is <br /> consistent with the remedy and performance standards set forth in the <br /> Amended Record of Decision for OU1 of the Abex Superfund Site (signed <br /> August 15, 1994) and the Explanation of Significant Differences (ESD) <br /> signed October 5, 1995. Both documents are contained in the Abex <br /> Administrative Record, which is located at the Portsmouth Public Library, <br /> Reference Section, and the offices of the U.S. Environmental Protection <br /> Agency, 1650 Arch Street, Philadelphia, PA. 19103-2029. <br /> <br />Sec. 11-49. Required notices. <br /> <br /> All notices required by this article to be provided to the U.S. Environmental <br />Protection Agency shall be provided to: <br /> <br /> Director <br /> Hazardous Waste Management Division <br /> U.S. Environmental Protection Agency <br /> Region llI <br /> 1650 Arch Street <br /> Philadelphia, PA 19103-2029 <br /> <br /> 2. That a new subsection (c) be enacted and added to Section 11-10 of the <br />Code of the City of Portsmouth, Virginia (1988) to read as follows: <br /> <br />Sec. 11-10. Permit required for land-disturbing activities. <br /> <br /> (c) There shall be a charge for the cost of processing and issuing a land- <br />disturbing permit to be collected from the applicant as follows: <br /> <br /> (1) Development of an individual single-family Iot involving over <br /> 2500 sq. ft. of land disturbance and located within the Chesapeake <br /> Bay Preservation Area Overlay District ...................... $50.00 <br /> <br /> (2) Multifamily development, subdivisions, and nonresidential <br /> development involving one acre or less ...................... $50.00 <br /> <br /> (3) Multifamily development, subdivisions, and nonresidential <br /> development involving more than one acre ................... $50.00 <br /> plus $35.00 for each additional acre or portion thereof. <br /> <br /> <br />
