AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 40-61.8 (b)(4) <br />THEREOF PERTAINING TO OFF-PREMISES SIGNS ON MARTIN LUTHER <br />KING EXPRESSWAY. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Section 40-61.8(b)(4) of the Code of the City of Portsmouth, <br />Virginia, be amended and reordained to read as follows: <br /> <br />Sec. 40-61.8. Streets having special sign restrictions. <br /> <br /> (b) The following streets are hereby designated as having special sign <br />restrictions: <br /> <br /> (4) Martin Luther King Expressway. Any nonconforming off-premises sign <br /> on the Martin Luther King Expressway (the "Expressway") between <br /> London Boulevard and the Midtown Tunnel that would be required to be <br /> removed as a result ora state or federal road project may be physically <br /> relocated to a point on the same side of the roadway as the sign's original <br /> location. The new location shall be at approximately the same point <br /> laterally along the Expressway as the original location of the sign, or of <br /> any other sign which is relocated pursuant to this section, and oriented in <br /> the same direction as the sign which had been at that location. Each sign <br /> which is relocated shall be subject to setback and height requirements <br /> applicable to off-premises signs, other than setback requirements <br /> applicable to expressways, as set forth in Section 40-61.2(9), plus any <br /> other requirements imposed by state or federal authorities of competent <br /> jurisdiction. <br /> <br /> 2.
