AN ORDINANCE CLOSING AND VACATING A 30' WIDE UNNAMED, UNIMPROVED PAPER STREET ON THE COX PROPERTY IN THE WEST NORFOLK SECTION OF PORTSMOUTH. WHEREAS, A.P.M. Terminals Virginia has requested the closure and vacation of a 30' wide unnamed, unimproved paper street on the Cox property in the West Norfolk section of Portsmouth, as hereafter described; and WHEREAS, the Planning Commission, at a meeting held on November 5, 2002, recommended approval of the closure and vacation of said 30' wide unmamed, unimproved paper street on the Cox property in the West Norfolk section of Portsmouth. and WHEREAS, notice of the proposed closure and vacation has been given the adjoining property owners in accordance with Section 15.2-2006 of the Code of Virgima. as amended. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth. Virginia that the 30' wide unnamed, unimproved paper street on the Cox property in the West Norfolk section of Portsmouth be closed and vacated as a pub!ic street and right of way as follows: UNNAMED. UNIMPROVED PAPER STREET All that 30' wide unnamed, unimproved paper street on the Cox property as shown on "EXHIBIT A. SHOWING 30' PUBLIC RIGHT-OF-WAY HEREBY VACATED" Portsmouth, Virginia, dated June 12, 2002, made by Baldwin & Gregg, attached hereto. BE IT FURTHER ORDAINED. that this Ordinance shall not take effect until the applicant has paid to the City of Portsmouth the sum of $12,565.00 for the right of way vacated and closed herein, and that this Ordinance shall not be recorded among the land records of the Clerk's Office of the Circuit Court of the City of Portsmouth until payment has been received as provided herein.
