sufficient to cover the costs, the applicant shall pay the difference within 30 days of the <br />billing date. No refund of the cost of an engineering study shall be made where, for any <br />reason, the permit apphed for is uot issued. <br /> <br /> (e) Permit in vehicle. Every permit issued under this section shall be carried <br />in the vehicle to which it refers and shall be available for inspection by any law <br />enforcement er by the City Manager Or his designee. <br /> <br /> (f) Reduced speed. Each vehicle, when loaded according to the provisions of <br />a permit issued under this section, shall be operated at a reduced speed. The reduced <br />speed limit shall be ten miles per hour slower than the legal speed limit in 55, 45 and 35 <br />mile per hour speed limit zones. <br /> <br /> (g) Conformity to legal limits. No pen-mit shall be issued for any vehicle or <br />load which reasonably can be reduced to the limitations of the size and ~veight contained <br />in Code of Virginia, so as not to require a penuit under this sectiun~ The weight and size <br />must be reduced to the absolute minimum and loaded in such a manner that will most <br />nearly conform to legal limits. <br /> <br /> (h) Exemption. No permit shall be required under this section for vehicles <br />exceeding maximum size requirements where such vehicles are exempt from size <br />limitations under the Code of Virginia. <br /> <br /> (i) Violation; penalty. It shall be a class 1 misdemeanor for any person to <br />violate any of the terms of the permit or of this section. In addition, the permit may be <br />revoked for any such violation, upon convictiou thereof, absenta showing that the <br />violation was based upon emergency or extenuating circumstances. A permit shall not be <br />reissued within six months of revocation. <br /> <br />Sec. 22-266.2. Police escort for certain ovenveight and oversize vehicles. <br /> <br /> Whenever a special permit is issued by City Manager or his designee for <br />overweight and oversize vehicles pursuant to this chapter or to the Code of Virginia, and <br />whenever it is determined that a police escort for such vehicles is required, a fee in the <br />amount $50.00 plus the actual costs of each police officer and equipment so required <br />shall be charged to the holder of such special permit. A police escort shall be required for <br />movement of 14 feet or greater width loads on all two lane roads. <br /> <br />Sec. 22-268.1. Vehicles hauling excavated material. <br /> <br /> The City Manager or his designee, upon written application made by the owner or <br />operator, shall issue overweight permits for operation of certain vehicles hauling <br />excavated material from construction-related land-clearing operations. Permits shall be <br />issued under this section only for vehicles that have either (i) four axles with more than <br />twenty-two feet between the first and last axle of the vehicle or (ii) three axles.
