AN ORDINANCE CLOSING AND VACATING A PORTION OF BARBOUR DRIVE. <br /> <br /> WHEREAS, Portsmouth Redevelopment and Housing Authority has requested the closure <br />of that portion of Barbour Drive as hereafter described; and <br /> <br /> WHEREAS, the Planning Commission, at a meeting held on July 2, 2002. recommended <br />approval of the closure and vacation of said portion of Barbour Drive; and <br /> <br /> WHEREAS. notice of the proposed closure and vacation has been given the adjoining <br />property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia that a portion of Barbour Drive be closed and vacated as a public street and right of way <br />as follows: <br /> <br /> BARBOUR DRIVE. <br /> <br /> All that portion of Barbour Drive lying between the eastern boundary of Elm Avenue and <br /> the northern boundary of South Street, more particularly described as follows, to-wit: <br /> Beginning at a point on the east side of Elm Avenue 225.03 feet south of County Street; <br /> thence running N.87°01'24"E. 149.37 feet; thence running along a curve to the right with a <br /> radius of 175.00 feet an arc distance of 217.52 feet: thence running S21°45'36"E.430.72 <br /> feet to the north side of South Street: thence running along South Street <br /> S68' 14'34'W.50.00 feet; thence running N. 21°45'36"W.430.72 feet; thence running <br /> along a curve to the left with a radius of 125.00 feet an arc distance of 155.37 feet; thence <br /> running S .87°01'24"W. t49.37 feet to the east side of Elm Avenue; thence running along <br /> the east side of Elm Avenue N.02°58'36"W. a distance of 50.00 feet to the point of <br /> beginning, as shown on survey attached entitled: "EXHIBIT SHOWING PORTION OF <br /> BARBOUR DRIVE TO BE CLOSED AND VACATED FOR WESTBURY, <br /> PORTSMOUTH, VIRGINIA", dated April 24, 2001, made by Horton & Dodd, P.C., <br /> Surveyors, Engineers & Planners. <br /> <br /> BE IT FURTHER ORDAINED, that the City of Portsmouth hereby reserves an easement <br />in the portions of Barbour Drive hereby closed and vacated for the installation, operation, <br />maintenance and replacement of public utilities, which said easements may be released, vacated or <br />relocated as needed by the City Manager of the City of Portsmouth as he may in his discretion <br />deem appropriate and in the best interest of the City of Portsmouth. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />August 13, 2002. <br /> <br /> Teste: <br /> <br /> City Clerk <br /> <br /> <br />
