AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF TI-IF, CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 22-2, 22-266, 22- <br />565(b), 22-582(b), 22- 583(a), 22-611(b), 22-616, 22-642(b), 22-644, 22-664(c), AND <br />22-760 THEREOF AND BY ADOPTING A NEW SECTION 22-6.1 PERTAINING <br />TO TRAFFIC OFFENSES, PENALTIES, AND FEES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Sections 22-2, 22-266, 22-565(b), 22-582(b), 22-583(a), 22-61 l(b), <br />22-616, 22-642(b), 22-644. 22-664(c), and 22-760 of the Code of the City of Portsmouth, <br />Virginia (1988) be amended and reordained to read as follows: <br /> <br />Sec. 22-2. General penalty for violations of chapter. <br /> <br /> (a) Unless othexwvise provided, a violation of any of the provisions of this <br />chapter shall constitute a traffic infraction punishable by a fine of not more than $200.00. <br /> <br /> (b) Every person convicted of any state statute or city ordinance shall be <br />assessed the sum of $5.00 as part of the costs in each traffic case in the district and circuit <br />courts. The assessment shall be collected by the clerk of the court in which the case is <br />heard, remitted to the city treasurer, and held by the city treasurer subject to appropriation <br />to the sheriff for the funding of courthouse security personnel. <br /> <br /> (c) The provisions of subsection (b) shall expire on July 1, 2004. <br /> <br />Sec. 22-266. Generally. <br /> <br /> The city manager may, in his discretion, upon application in writing and good <br />cause being shown therefor, issue a special permit in writing authorizing the applicant to <br />operate or move upon the highways, a vehicle or a size or weight exceeding the <br />maximum specified in this article. Every such permit may designate the route to be <br />traversed and contain any other restrictions or conditions deemed necessary by the city <br />manager, except as otherwise provided in this division. Unless otherwise specified in this <br />division, the following processing fees fqr such permit shall be.charged: <br /> (1) Annual (blanket) permit: <br /> First unit ........... 200.00 <br /> Each additional unit... 100.00 <br /> <br /> (2) Single trip permit ........... 50.00 <br /> <br /> <br />
