UP-O1-25 <br /> <br /> Beginning at the northwest corner of the intersection of <br /> County Street and Phoebus Street; thence, east 352'+ to a <br /> point; thence, north 230'+ to a point; thence, west 350'+ to <br /> a point; thence; in a southerly direction 230'+ to the point <br /> of the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which shall be <br />observed by the applicant and any successor in interest: <br /> <br /> (a) Occupancy of the facility shall be limited to 23 school age children from <br /> kindergarten through 6th grade. <br /> <br /> (b) Approval of the outdoor play area and fencing must be received from the <br /> Downtown Design Committee. <br /> <br /> (c) The indoor hours of operation shall be from 6:00 a.m. to 6:00 p.m., <br /> Monday through Friday. <br /> <br /> (d) Outdoor hours of operation shall be limited to between 8:00 a.m. and 6:00 <br /> p.m. <br /> <br /> (e) The facility shall be subject to all required inspections by the City's Fire <br /> Department Bureau, Health Department, and Building Official. <br /> Inspections shall include an initial inspection prior to occupancy and <br /> annual inspections thereafter. <br /> <br /> (f) The facility shall comply with all applicable local, state and federal <br /> regulations including the conduct of required inspections and the <br /> maintenance of necessary licenses. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia, at meeting held on <br />January 8, 2002. <br /> <br /> Teste: <br /> <br /> City Clerk <br /> <br /> <br />
