UP-02-O1 <br /> <br /> Beginning at the northwest corner of the intersection of Green <br /> Street and Queen Street; thence, north 85'_+ to a point; thence, <br /> west 93'+ to a point; thence, south 85'+ to a point; thence, east <br /> 93' to a point of the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions: <br /> <br /> (a) All exterior alternations to the property, including signage and <br /> landscaping, must receive prior approval from the Downtown Design <br /> Committee which may, in keeping with its guidelines, require alternative <br /> features. <br /> <br /> (b) The hours of operation shall be limited to between 11:30 a.m. and 2:00 <br /> a.m. daily. Occupancy of the facility shall be limited to eighty persons, <br /> subject to approval of the table arrangement and layout by the Building <br /> Official. <br /> <br /> (c) All activities conducted on this site shall be in compliance with Section <br /> 24-255 of the City Code pertaining to loud disturbances and unnecessary <br /> noise or sound. <br /> <br /> (d) The applicant shall develop a plan for trash storage, handling, and <br /> removal, and the plan must be approved by the City's Director of General <br /> Services prior to commencement of operations. <br /> <br /> (e) The applicant and any successor in interest shall comply with all <br /> applicable codes, ordinances, and regulations of federal, state and local <br /> governments and shall obtain and maintain in effect ail necessary licenses <br /> and permits. <br /> <br /> (f) All taxes and fees in connection with the subject property and operation <br /> shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia, at meeting held on <br />February 26, 2002. <br /> <br /> Teste: <br /> <br /> City Clerk <br /> <br /> <br />
