3. That the use permit is approved subject to the following conditions: <br /> <br /> (a) The occupancy of the child care center shall be limited to no more than <br /> thirty-five (35) children. <br /> <br /> (b) Indoor hours of operation shall be limited to 6:00 a.m. to 6:00 p.m. <br /> <br /> (c) Outdoor play hours shall be limited to the hours between 8:00 a.m. and <br /> 6:00 p.m. <br /> <br /> (d) The 3,795 square foot outdoor play area shall be enclosed with a privacy <br /> fence eight (8) feet in height. <br /> <br /> (e) The applicant shall maintain at least six (6) off-street parking spaces for <br /> the child care center. <br /> <br /> (f) The center shall comply with the submitted site plan and floor plan. The <br /> center shall also comply with the submitted front elevation, dated August <br /> 15, 2002. The side and rear elevations shall be architecturally consistent <br /> with the submitted front elevation. <br /> <br /> (g) The applicant shall present a landscaping plan and detailed architectural <br /> plans for Planning Staff approval. <br /> <br /> (h) The site must adhere to the 10% tree canopy site requirement and the <br /> parking lot screening requirement, which requires a landscaped buffer to <br /> screen the parking area from the rights-of-way of Madison and Seventh <br /> Streets, outlined in City Code Sections 40-70 through 40-74. <br /> <br /> (i) The applicant shall utilize the City's services for trash/garbage removal, as <br /> indicated in a memo received from the Director of General Services. dated <br /> July 29, 2002. <br /> <br /> (j) An enviromnental site assessment and an asbestos study shall be <br /> performed. The results shall be reviewed and approved by the Building <br /> Official prior to applying for and obtaining any building permits. <br /> <br /> (k) The underground oil tank in the proposed parking area shall be removed <br /> during the construction process. <br /> <br /> (l) The center shall submit to all required inspections by the City's Fire <br /> Department Bureau, Public Health Department, and Building Official. <br /> This requirement shall include an initial inspection prior to the opening of <br /> the business and annual inspections thereafter. <br /> <br /> <br />
