Section 8-88. Penalties. Any person violating any of the provzsions of this article shall, upon conviction thereof, he punished by a fine of not less than Twenty-five Dollars nor more than Five ~undred Dollars, and such conviction and payment of fine shall not relieve any such person from the ~aymen~ of any ~ax imposed hereunder. Each violation of, or non-compliance with, any of the provlsions of this article shall be and constitute a separate offense and shall subject every person convicted there- of To the p~nalties prescribed herein. Section 2 ~ (a) This ordinance s~tl be in force and effect from and after July t~ 1959~ provided, however, that the ordinance adopted on December 26, 1950, shall remain in force and effect until thai time and any stamp, decalcomania- in- signia, or symbol printed by a meter machine lawfully evidencing the ~yment of the tax imposed thereby Upon the sale of cigare~ses shall be valid for use ~n connection with the tax imposed by this ordinance. (b) ~nould a seller have in his possession, on the effective d~te of this o~dina~ce, any unstamped or improperly sLamped tobacco products, or skoutd a seller, after such effective date, obtsin or acquire possession of any unsta~ped or improperly stamped tobacco products, such seller shall forthwith, before selling~ offerin~ or exposin~ such tobacco products for s~le in the city, purchase an~ affix or cause to be affixed to such tobacco products the proper sT~mps~ or the markings of a meter machine, coverin~ the tax imposed by ~hls ordinance, pursuant to regulations promulgated by the director of finance. Section 3. If any par~ of this ordinance shall be for any reason adjudged invalid, such invalidity shall not affect the parts which are not adjudged invalid~ Adopted by the Council May 26. 1959 True copy.
