Be it ordained By the Council of the City of Portsmouth, Virginia: Section i: That Chapter 8 of the Code of the City of Portsmouth, Virginia, 195t, be amended by adding thereto a new Article numbered VIII to read as follows: Section 8-78. Definitions. The following words and phrases when used in this article shall, for the purposes of this article, have the following respective meanings, except where the context clearly indicates $ different meaning: (a) Agent. The word "a~ent" shall mean ~nd include every dealer and other person who shall be authorized by the director of finance to purchase a~d affix stamps to tobacco products under the provisions of sectic~ 8-81 of this Code. (b) Dealer° The word "dealer" shall mean and include every manufacturer, jobber, wholesale dealer or' other person who supplies a seller with tobacco products (c) Director of finances The words "director of finance'~ shall mean and include the director of finance of the city and every person duly authorized by him ~o serve as his representative, (d) l~ackage. The word "package'~ shall mean and include every package~ box~ can or other container of any tobacco product~ irrespective of the material from which such container is m~de, in or from which retail sales of such tobacco product are normally ~ade Or intended to be ~ade. (e) Purchaser° The word "purchaser" shall mean and include every person · o whom the title to any tobacco product is transferred by a seller within the cor- porate limits of the city. (f) Sale. The word "sale" shall mean and include every act or transaction, irrespective of the method or means employed~ including the use of vending machines and other mechanical devices, whereby title to any tobacco product shall be ~rans- ferred from the seller, as herein defined~ ~o any other person within the corporate limits of the city, but shall not include any such act or transaction the taxation whereof by the city is precluded or prohibited under the constitution or the general laws of the state, Seller.
