AN ORDINANCE TO AMEND SECTION 32 OF CHAPTER 19 OF THE CODE OF THE <br />CITY_ OF PORTSMOUTH, VIRGINIA, 1951, ENACTED ON AUGUST 28, 1956, <br />CREATING THE PORTSMOUT~ FIRE AND POLICE RETIREMENT SYSTEM, AS A3F~/NM)- <br />ED, TO PROVIDE THAT ORDINARY DISABILITY RETIREMEAwr SHALL BE CONVERTED <br />TO NORMAL SERVICE RETIREMENT UPO~ THE MEMBER RF~tCHING NORMAL RETIRE- <br />5&ENT AGE. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, Virginia, that <br />Section 32 of Chapter 19 of the Code of the City of Portsmouth, Virginia, 1951, <br />as amended, be amended and reord~ined to read as follows: <br /> Section 32. ORDINARY DIHAEILIT¥ RETIP~-"~ENT ALLOWANCE.-- (a) Upon retire- <br />m~nt as provided in Section 31, a member shall receive an annual retirement <br />allowance p~yable monthly during his lifetime and continued disability of an <br />amount eqllat To the following: <br /> <br />(1) If such retirement occurs more than five years and <br />six months prior to normal retirement date, one and one- <br />third per centum of his average final compensation multi- <br />plied by his number of years of creditable service, not <br />in excess of twenty-five° <br /> <br />(2) If the period from the disability re~iremen~ date to the <br />normal retirement date is five years and six months or less, <br />an amount calculated as in (1) except that in place of one <br />and one-third per cemtllm there shall be 1used a per centum <br />determined by deducting from two per centlgm the product of <br />(l) 1/100 of one per centum and (ii) the number of full <br />months from date of disability retirement to normal retire- <br />ment date. <br /> <br /> (5) For the purposes of this section the retirement allowance shall be <br />determined on the assumption that the retirement allowance is payable go the <br />member alone and that no optional retiremen~ allov~ance is elected. <br /> <br /> (c) Notwithstanding the provisions of subparagraphs (a) (t) and (2) hereof, <br />any member who has retired on ordinary disability retirement under Section 31, <br />upon reaching normal retirement age shall thereafter be entitled to normal <br />service retirement and associated options, the annual retirement allowance being <br />computed on the basis of average final compensation and years of creditable <br />service attained at the date of ordinary disability retirement. <br /> <br />Adopted at a meetir~g of City ~om~eil on Becember 29. 1959. <br /> <br /> <br />
