A~ ORDINANCE REQUESTING THAT THE GENEP~%L ASSEMBLY A~.~D CHAPTER I, <br />SECTION 4; CHAPTER III, SECTION 23; CHAPTER III, SECTION 23-e; <br />CHAPTER IV, SECTION 32; CHAPTER IV, SECTION 46; CHAPTER IV, SEC- <br />TION 46-a; CHAPTER IV, SECTION 47; CHAPTER IX, SECTION l-a; C_MAP- <br />TER X, SECTION 2; A~ND CHAPTER XII, SECTION 5 OF THE CHARTER OF <br />CITY OF PORTSMOUTH IN THE ~%N~ER THEREIN DESCRIBED. <br /> <br /> WHEREAS, Sections 15-65~3 and 15-77.74 of the Code of Virginia, 1950, <br />as amended, provide for amendment of city charters u~on the holding of a <br />public hearing and request of the City Council to the General Assembly; and <br /> <br /> W~ERFAS, the City Council is of the opinion that certain amendments to <br />the Charter of the City of Portsmouth are necessary and desirable aT this time, <br />and has held the public hearing specified in the above-mentioned code sections. <br /> <br /> NOW, THEREFORe, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that: <br /> <br /> Section 1. The City Attorney is hereby directed to prepare, and the City <br />Manager to transmit to the General Assembly, together with certified copies of <br />this ordinance, drafts of bills amending the hereinafter mentioned sections of <br />the Charter of the City of Portsmouth so that said sections shall read as <br />follows: <br /> <br />Chapter I, Section 4. Election and terms of councilmen. <br /> <br /> The councilmen shall he ~lec~ed at large and shall hold office for terms <br />of four years each beginning on the first day of July next followiD~ the date <br />of their election and until their successors are duly elected and qualified~ <br />Four of the councilmen shall he elected in the general election to be held in <br />June of 1960 and every four years thereafter° Three of the councilmen shall <br />be elected in the general election to be held in June of 1962 and every four <br />years thereafter. Provided, however~ the terms of those councilmen now in <br />office whose terms would otherwise extend until September 1, 1960, shall expire <br />on July 1, t960~ and the terms of those councilmen now in office whose terms <br />would otherwise extend until September i, 1962, shall expire on July 1~ 1962. <br /> <br />Chapter III, Section 23° General powers° <br /> <br /> 'The powers set forth in Sections 15-77.5 through 1~77.70, inclusive, of <br />Chapter 5.1 of the Cede of Virginia as in force on January 1, 1960, are hereby <br />conferred on and vested in the City of Portsmouth. <br /> <br />Chapter III, Section 23-eo Election and terms of members of Planning <br /> <br />Commission~ <br /> <br /> The members of the Planning Commission created under the provisions of <br />general la~ hereafter shall be elected by the council and shall serve for such <br />term as may ~e ordained by the council within the limits of general law~ ex- <br />cep~ that the council may by ordinance prescribe shorter te~ma, for any member <br />or members of the Plannin~ Commission thereafter elected, for the purpose of <br />staggering the terms of office so that the zerms of some member or members shall <br />commence each year, but subsequent terms served by such member or members or <br />their successors in office shall b~ of the same length as the terms served by <br /> <br /> <br />
