AN ORDI?3=N~CE TO A~%~--~ND C~HAPTER I, 8~TION 19, OF <br />O~I!~ANCE OF ~ CITY OF PORTSM~ ADOPTED FEBRUARY 15, I~55, <br />AS A~I~D~ TO PROVIDE A PEN~TY OF TEN PER CENT~ <br />A t~!Nt~ OF TWO D~RS (~.00) ~ FOR ~TE <br /> <br /> Be it ordained by the Council of the City of Portsmouth, Virginia, that <br />Chap~cer I, Section 19~ of ti%= License Tax Ordinance of the City of Portsmouth, <br />adopted February 15, leSS, as amended, be amended and rs-ordained to read as follows: <br /> <br /> §19. PENALTIES ~ND FINES. Ca) P~alty for non-payment of License Tax. <br />Any person comducting a husiness~ trade or occupation~ or doing other thin~s for which <br />~ license t~x is required ~der this or~in~nce, without first obt~ini~ such license <br />oF who shall f~i! to obtain ~ny t~ or si~ required under this ordi~nce~ sh~i1 ~ <br />liab!~ to a fine of not less th~n $10.00 nor mom~ than ~50.00~ e~ch day of default <br />shslt constitm~e a seR~r~te off.se. <br /> <br /> Such conviction shall not relieve any such person from the pa~ent of ~y <br />license tax imposed by this ordinance. <br /> <br /> Cb) If any license tax imposed by this ordinance is not paid by May Slat, <br />there shall he added to said license t~x a pen~!ty of t0 per cent~ of the amount of <br />said license t~, ~ut such penalty shall in no case be less than two C$2.00) dollars, <br />to be assessed and i~id along with said license as part thereof° <br /> <br /> Cc) Penalty for not m~king appiicgtion. It shall be the duty of every per- <br />son doing husiness~ or carrying on any trade or occupation within the City of Ports- <br />mouth, and of any person who shall open any office, have a place of business, or shall <br />by use of signs or otherwise advertise any business, trade or occupation within said <br />City~ to m~ks application to the City Collector for the license due under this ordinance~ <br />and any person failing to make such application shall be fined not less than ten ($10.OO) <br />dollars, nor more than fifty C$50.O0) dollars, as the Judge or jury m~y determine. And <br />it shall be the duty of the City Collector to keep ~ record of alt such applications° <br /> <br /> rd) ItteEal Transfer of License. Any person transferring or attempting to <br />transfer any license contrary to the provisions of this chap=er shall be fined no~ less <br />than ten ($10.00~ dollars, nor mere than fifty ($50~00) dollars. <br /> <br /> (e) Display of License° Any person failing to display his license as re- <br />quired by Section 13 of this Chapter, or any person failing to display properly any <br />license tag or gro~er~s si~n required under this provision of this ordinance to bs dis- <br />played in a particular wmy, shall be g~ilty of a misdemeanor and fined an amount not to <br />exceed ten C$i0~00} dollars: <br /> <br /> Cf) Keeping of Records. Any person who shall fail or refuse to keep such <br />records as required by Section 14 of this Chapter shall be assessed with and shall pay <br />a pem~!ty of twenty-five C$~5.00) dollars, In addition to the license tax imposed° <br /> <br /> C~) Interrogatories to Applicant for License. Any applicant refusing ~o <br />answer such interrogatories under o~th as are required by Section iO of t~is Chapter <br />shall be fined not more tD~n one hundred C$100.O0) dollars. <br /> <br /> <br />
