A~N ORDINANCE TO A~END SECTION 17-57 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1951, AS A~ENDED, RELATING TO THE SALE, <br />ETC., OF PISTOLS, DIRKS, BOWIE KNIVES, SLLg~G SHOTS, SWITCH-BLADE <br />KNIVES AND WEAPONS OF LIKE KIND. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, <br />Section 17-57 of the Cods of the City of Portsmouth, Virginia, <br />ed, be amended and reordained to read as follows: <br /> <br />Virginia, that <br />1951, as amend- <br /> <br />Section 17-57. Same - Permit Prerequisite to Sale, eze. <br /> <br /> (A) No person shall sell, rent, give or otherwise furnish [hereinafter <br />referred to as "sell") to any person within the City any pistol, dirk, bowie <br />knife, slung shot, switch-blade knife or any weapon of a like kind, unless <br />and until the recipient thereof (hereinafter referred To as purchaser ) shall <br />present to such person (hereinafter referred to as "dealer") a permit granted <br />by the Chief of Police authorizing the purchaser to purchase or acquire such <br />w~apon. <br /> <br /> (B) Whenever the applicant for a permit to purchase or acquire such a <br />weapon produces a certified order of the Judge of the Court of Hustings author- <br />izing the applicant to carry the subject weapon as a concealed weapon, the Chief <br />of Police shall issue the permit to purchase or acquire forthwith. In cases <br />where the subject weapon is not to be carried as a concealed weapon, the Chief <br />of Police shall issue the permit to purdhase or acquire subject to the following <br />regulations: <br /> <br />t) _The applicant must personally sign and complete a <br /> written application for the permit. <br /> <br />2) The applicant must be fingerprinted by the Police <br /> Department. <br /> <br />9) <br /> <br />A report of the police records of the applicant <br />must be obtained by the Police Department from the <br />Federal Bureau of Investigation. <br /> <br />4) The applicant must show a lawful use for the subject <br /> <br />5) <br /> <br />When such investigation discloses that the public <br />welfare will be prejudiced by permitting a person <br />of known mental instability or criminal activity <br />involving breach of the peace, such a permit shall <br />not be granted. <br /> <br /> (C) All dealers in the subject weapons shall keep an accurate register of <br />the number and character of such~weapons p~rchased, name of person from whom <br />purchased and date of purchase, and likewise keep an accurate record of each <br />sale of such weapon, which shall show the date of sale, the name of the pur- <br />chaser and the n~mber and character of the weapon. Such records shall be open <br />to the inspection of any police officer of the City, and a copy of the same <br /> <br /> <br />
