AN ORDINANCE TO i~2~D CHAPTER 16 OF THE CODE OF THE CITT OF <br />PORTSMOUTH, VIRGINIA, 1951, AS AMENDED: BY ~MENDING AND REOR- <br />DAINING SECTIONS 16-9, 16-10, 16-14, 16-17, 16-23, 16-36 AND <br />16-51 THEREOF CONCERNING ROUTES AND HEADWAYS OF MOTOR BUSES, <br />REASONABLE RETURN ON INVESTMENT, RATES OF FARE, PA~-MENT IN LIEU <br />OF LICENSE TAXES, tNDEMNIFICiTION OF CITY, THE GRANTING OF A <br />PEEMIT AND THE PROVISION OF A BOND AhrD INSURANCE COVERAGE AND <br />PROHIBITING THE CARRYING OF INTRA-CITY PASSENGERS IN CERTAIN <br />CASES. <br /> <br />that: <br /> <br />Be it ordained by the Council of the City of Portsmouth, Virginia <br /> <br />Section 1. <br /> <br /> 'Chapter 16 of the Code of the City of Portsmouth, Virginia. 1951, <br />as amended, is hereby amended by amending and reordaining Sections 16-9, <br />1~-10, 16~t4, 16-17, 16-23, 16-36 and I6-51 to read as follows: <br /> <br />Section 16-9. Routes and Headwaye - Designation. <br /> <br />under ~he provisions of this article shall be along the streets of the city <br />las may be designated from time to time by the council through adoption of a <br />re~olution prescribing the same. Any such resolution may specify minimum <br />headways between buses on such routes and failure to operate within such <br />~pecified headways shall be deemed a violation of Section 16-15 of this code <br />whenever.the~ council determines such failure to be injurious ~o the public <br />wek~are and not warranted by the circumstances. <br /> <br />Section 16-10. Same - Change - Reasonable return on investment. <br /> <br /> The right to continue to operate on the rouzes hereinabove provided, <br />or: any routes which may be designated, as hereinafter provided, shall he upon <br />the condition that whenever public convenience shall, in the opinion of the <br />council of the city or any company or individual operating hereunder, reason- <br />ably~require' any change in the above routes, or any extension thereof, the same <br />sh~ll be made and established with all reasonable dispatch and diligence upon <br />being required or allowed so to do by the council of the city; but no change <br />or extension of routes which requires additional capital outlay or increased <br />operating expenses by the company or individual operating hereunder shall be <br />required by the council of the city a~ any time when it appears that from the <br />resulis of the operation for the preceding six months, the company or indivi- <br />dual conducting such operation has not been receiving a reasonable return on <br />th~ ehtire~fnvestment used in the bus service in thecity, and in determining <br />this zssue'it shall be recognized between the parties that a net return of six <br /> <br /> <br />
