AN OI{D~ANCE TO AMEND SECTION 3-5 OF THE ZONING ORDINANCE <br />OF T~E CITY OF PORTSMOUTH, 1961, REIATING TO CONTINUANCE <br />OF N~-CONFORM~NG STRUCTURES. <br /> <br /> Be it ol~laiued by the Council of ~he City of l~rtsmouth, Virgin~a, <br />that Section 3-5 of the Zonin~ O~dinance of the City of PortSmouth, 1961, he <br />amended and ~eordained to read as follows: <br /> <br />Section 3-5. Continuance of Non-Conformiz~ St~tul~s. <br /> <br /> The ~ses permitted by this ordinance may be established as a new <br />use within the districts as provided in Article 4 in any existing ~ullding <br />which does not conics with the dimensional ~equirements of the district, pre- <br />vided the off-street parkin~ requirements of that district are coml~lied with, <br />and provided further that if any building or any part thereof iS remedeled or <br />rebuilt to an ext~t ~ceedin~ one third of its then reprodu~ible value, ~x- <br />elusive of foundatio~s, as determined by the Buildin~ Official, or if any new <br />~tructures are el'~cted, the entire such building or str~/cture must be in <br />fo~m~noe with the dimensional requirements of the district, but additions not <br />e~ceed~ one thil~t of its then repl-oducible value determined as aforesaid may <br />be made to any sv~h building p~ovided that such additions conform with the <br />dimensional requ~ce~ents of the district. <br /> <br />the Council of the City of Portsmouth at a meeting held <br /> <br />Tes te: <br /> <br />City Clerk. <br /> <br /> <br />
