AN ORDINANCE TO AMEND SECTION 26-37 OF THE CODE <br />OF THE CITY OF PORTSMOUTH, ,VIRGINIA, 1961, <br />PERTAINING TO THE REFUND OF CONTRIBUTIONS TO <br />THE PORTSMOUTH SUPPLEMENTAL RETIREmeNT SYSTEM <br />UPON ~ITHDRA~AL OR DEATH OF MEMBER BEFORE <br />RETIREMENT. ,, <br /> <br /> Be it ordained by the Council of the City <br /> of Portsmouth, Virginia, that section 26-37 of <br /> Code of the City of Portsmouth, Virginia, 1961, <br />be amended and reordained to read as follows: <br /> <br />Sec. 26-37. <br /> <br /> retire <br /> <br />Refund of contributions upon <br />withdrawal or death before <br /> me~t. <br /> <br /> .'{a} If a member h~ <br />otherwise than by death, c <br />provisions of this article <br /> <br />ceased to be an employee <br />by retirement under the <br />he shall be paid, on <br /> <br /> demand, but not la:er than ainety days thereafter, <br /> the amount of his accumulated contributions <br /> reduced by the amount of smy retirement allowance <br /> previously received by him under any of the <br /> j provisions of this article, Should such a member <br /> die after ceasing to be an,employee but before <br /> retirement and before receiving the amount of his <br /> '.accumulated contributions, the amount of his <br /> accumulated contributions reduced by the amount of <br /> any retirement allowance p~eviousl¥ received by <br />him under any Of the provigions of this article <br />'~- shall then be payable in a lump sum in accordance <br /> with section 26-42. <br /> <br /> (b) Should a m~mber die in service at <br />any time before attaining ~is sixtieth birthday, <br />the amount of his accumulated contributions reduced <br />by the amount of any retirement allowance previously <br />received by him under any of ~he provisions of <br />this article shall then be payable in a lump sum- <br />in accordance with section 26-42. <br /> <br />Virginia, at <br /> <br />the Coundil of the City of Portsmouth, <br /> October 9, 1962, <br /> <br /> <br />
