A-N ORDINAlqCE TO PROVIDE FOR THE ACQUISITION OF CERTAIN <br />PROPERTY BY THE CITY OF PORTSF~DUTH UNDER EMINENT DOMAIN <br />PROCEEDINGS PURSUANT TO C~APTER 258 OF THE' ACTS OF <br />ASSEMBLY OF 1958, SkID PROPERTY BEING NECESSARY FOR <br />IMPR~ OP A PORTION OF PORTSMOUTH BOULE~VARD, <br />ROtVfE 337, PARCEL <br /> <br /> WHEREAS, the City. of Portsmouth has found it %o be <br />necessary to widen and otherwise improve a portion of Portsmouth <br />Boulevard, Route 337, under a Federal Urban Aid Program whereby it <br />is the resp~nsibilityof the said City to acquire all necessary <br />additional property; and <br /> <br /> WHEP~EAS, the City of Portsmouth has not been able to <br />purchase certain property necessary to this project because the <br />owners thereof haYe refused to sell the same to the City at the <br />.price set by appraisers employed to value said property; and <br /> <br /> WHEREAS, advancement of the work will be delayed un- <br />reasonably if the said property is not made available as soon as <br />possible. <br /> <br /> NOW, THEREFORE, be it ordained by the Council of the <br /> City of Portsmouth, Virginia, that the City Attorney is directed <br /> to institute eminent domain proceedings, employing counsel for <br /> that purpose, against the property hereinafter described, in <br /> accordance with and pursuant to Section 23-f of the Charter of <br /> the City of Portsmouth (Chapter 258 of the Acts of Assembly of <br /> 1958), and that the sum of $435.30 be deposited to the credit of <br /> the court as provided by law to compensate the owners thereof: <br /> <br />(a) The owners of record are ~s follows: <br /> Joseph E. Knight and Ellen S. Y~ight. <br />(b) The interest to be acquired is the fee simple <br /> estate in and to the property hereinafter described. <br />(c) The approximate area is 900 square feet. <br />(d) The description of the property is as follows: <br /> <br /> That certain parcel of land situate in the City <br />of Portsmouth, Virginia, more particularly described <br />as follows= <br /> <br /> That part of Lot No. 5, on a plat entitled "Ports- <br />mouth ~eights, Norfolk County, Virginia", made by <br />S. W. Arrcistead, C.E., recorded in the Clerk's Of- <br />fice of the Circuit Court of the City of Chesapeake <br />(formerly Norfolk County), in ~ap Book 27, at page <br /> <br /> <br />
