AN ORDINANCE TO PROVIDE FOR THE AC~UiSiTiON OF CERTAIN <br />PROP2RTY BY T~E CITY OF PORTSMOUTH ~I'~DER EMINENT DO~%AiN <br />PROCEEDINGS PURSUANT TO CHAPTER 258 OF THE ACTS OF <br />ASSEMBLY OF !958~ SAID PROPERTY BEING NECESSARY FOR <br />iMPROVEF~NT OF A PORTION OP PORTSMOUTH BOULEVARD, <br />ROUTE 337~ PARCEL !27. <br /> <br /> ~[EREAS, the City of Portsmouth has feuno it to me necessary <br />to widen and otherwise improve a por[~ion of Portsmouth Boulevard, <br />Rouen 337, under a Federal Urban Aid Pro,ram whereby it is the <br />responsibility ef the said City to acquire ell necessar5 additional <br />property; and <br /> <br /> %^?i[EREAS, the City of Portsmouth has not been able to purchase <br />certain property necessary to this project because the owners thereof <br />and the City have not been able to agree upon the price~ be paid <br />therefor} and <br /> <br /> ~[BN~AS, the advancement of the work will be delayed unreason- <br />ably if the said proper~y is not made available as soon as possisle. <br /> <br /> NOW~ THEREFORE: be it ordained by the Council of the City of <br />Portsmouth, Virginia, qhat the City Attorney is directed to institute <br />eminent domain proceedings~ employing counsel for that purpose, against <br />the property hereinafter described, in accordance with and pursuant <br />to Section 23-f of the Charter of the City of Portsmouth {Chapter <br />258 of the Acts of Assembly of 1958), and that the sum of $36~.14 <br />be deposited to the credit of the court as provided by law to com- <br />pensate the owners thereof~ <br /> <br />{a) The owners of record are as follows: <br /> Thomas Bacon Lane, Dorothy Lane Bailey, Charles D. <br /> Lane, Jr., Benjamin A. Lane, Edwin L. Lane, Comfort <br /> Lane Hand~ and Jack E. Lane. <br />{b) The interest to be acquired is the fee simple estate <br /> in and to the property hereinafter described as <br /> Parcel 127Z, a two year construction easement in <br /> and to the property hereinafter described as Parcel <br /> 127Y; and a permanent drainage easement hereinafter <br /> described as Parcel 12IX. <br />{c) The approximate area of Parcel !27Z is 1,875 <br /> square feet, of Parcel 127Y is 2,364 square feet, <br /> and of Parcel 127X is 2,869 square feet. <br />{d) The description of the property is as fo!lows: <br /> <br /> Those certain parcels of land situate in the City <br />of Portsmouth, Virginia, more particularly descrioed <br />as follows: <br /> <br /> <br />
