AN ORDINANCE TO PROVIDE FOR THE AC~UiSiT!ON OP CERTAIN <br />PROPERTY BY THE CiTY OF PORTSk%0UTH UNDER EMINENT DO?S~iN <br />PROCEEDINGS PURSUANT TO CSiAPTER 258 OF THE ACTS OF <br />ASSEF~LY OP 1958, SAID PROPERTY BEING NECESSARY FOR <br />iMPROVE~6ENT OF A PORTION O~ PORT~HCUTH BOULEVAP~, <br />ROU~E 337, PARCEL 017, <br /> <br /> %~UdEREAS, the City of Portsmouth has found !~ to se necessarI <br />uo widen and otherwise Improve a portion of Portsmouth Boulevaro. Route <br />337, under s Federal Urban Aid Program whereby ~n is the responsi£ility <br />of the said City to acquire all necessary additional properuy; and <br /> <br /> [~iEREAS, the City of Portsmouth has no~ Dean able Lo purchase <br />certain property necessary ~o ntis prolec~ because tee owners thereof <br />and the Cmty have no~ seen able ~o e?ree upon the price to se paid <br />therefor; and <br /> <br /> ~P[EREAS, advancement of the work will be delayed unreasonably if <br />the said property is no5 made available as soon as possiole. <br /> <br /> NOW~ THEREFORE, be it ordained my the Council of the 2ltv of <br />Portsmouth, Virginia, that the City atmorney is directed no institute <br />emznent domaln proceedings, employing counsel feE that purpose, egaznsn <br />the propertv neremnafter described, in accordance with and pursuanm rs <br />Section 23-f o~ the Charter of the City of Portsmouth ~Chap~er 258 of <br />the Acts of Assembly of 1958), and that the sum of S89.75 be deposited <br />~o the credl~ of the court as provided by law to compensate the owners <br />thereof: <br /> <br />{a} The owners of record are as follows: <br /> George M. Rose and Delores Rose. <br /> The interest mo be acqulree zs the rea simple estate <br /> in and no the preperey hereinafter described as <br /> Parcel 017. <br />{c) The ~pproxlmate area of Parcel 0i? is 350 scuare feet. <br />{d) The description of the property is as fotlows~ <br /> <br /> That certain parcel of land situate in the Cmtv of <br />Portsmouth, Virginia, more particularly described as follows~ <br /> <br />Parcel 017 <br /> <br /> That part of Lot 72, as shown on that certain plat enuitled: <br />"Mayflower Park, Plat NO. 2~ dated November 29, 1951, recorded ~n the <br />Clerk's Office o! the Circuit Court of the City of Chesapeake {formeri5 <br />Norfolk County) in Map Book 34, a~ page 12. lying between the southern <br />right of way line of Portsmouth Boulevard and a line parallel thereto <br />and 5 feet south thereof; bemng the front ~ feet of the land conveyed <br /> <br /> <br />
