AN ORDINANCE TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THB <br />CITY OF PORTSMOUTH UNDER EB{INENT DONt~IN PROC~EDINGS PURSU~\~r TO CHAPTER <br />258 OF 514E ACTS OF ~SSEMBLY OF 1958, SAID PROPERTY BEING NECESSARY FOR <br />USE AS A SITE FOR A NATIONAL GUA~ Ar~{ORY. <br /> <br /> WHEREAS, the City of Portsmouth has found it to be necessary to acquire <br />the fee simple title in and to the hereinaf%er described parcels of land <br />situate in the City of Portsmouth, Virginia, for use as the site of an <br />armory; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase certain <br />property necessary to this project because the owners thereof and the City <br />have not been able to agree upon the price to be paid therefor, or the City <br />has not been able to locate cergain of the owners or because of the status <br />of the title of certain parcels of the prope~'ty; and <br /> <br /> WHEREAS, advancement of the work will be delayed unreasonably if the <br />said property is not made available as soon as possible. <br /> <br /> NOW, THEREFORE, be it ordained by the Council of the City of Portsmouth, <br />Virginia: <br /> <br />Section 1. The City Attorney ~s directed to institute eminent domain <br />proceedings, employing counsel for that purpose, against the property <br />hereinafter described located in Washington H~ights, for the purpose <br />of acquiring the fee simple interest therein, in accordance with and <br />pursuant to Section 23-f of the Charter of the City of Portsmouth <br />[Chapter 258 of the Acts of A~sembly of 1958), and to deposit to the <br />credit of the cottrt as provided by law the sums specified to compensate <br />the respective owners of the various parcels of land: <br /> <br />PARCEL <br /> <br />O{~NER LOT BLOCK COMPENSATION <br /> <br />Charlie Franklin and Mamie <br />B.
