two hours of the alleged offense. <br /> (c) If a person after bei~l~ ~rested for a viola- <br /> tion of ~ 18-52 and after havi~ been advised by the <br /> a~esting officer that a person who operates a movor <br /> vehicle upon a public highway in this State shall be <br /> deemed thereby, as a condition of such operation, to <br /> nave consented to have a sample of his blood taken for <br /> a chemical test to determine the ateholic content <br /> thereof, and that the un~easonable refusal to do so <br /> constitutes grounds for the ~revocation of the privilege <br /> of operating a motor vehicle upon the highways of this <br /> State, then refuses vo De~t the taking of a s~mple <br /> of his blood f~r such tests, the arresting officer <br /> shall take the person az~ested before a co~itti~% <br /> msgistrate and if he does again so re~se after having <br /> been further advised by such ~vagistrate of the law <br /> requiring a blood test to be taken and the penalty for <br /> refusal~ and so declares again his refusal in ~iting <br /> upon a form provided by the Chief [~edical Examiner of <br /> Vir~nia (hereinafter referred ~o as Chief Medical <br /> Examiner), or re~uses or falls ~o so declare in writing <br /> and such fact is certified as prescribed in ~aragrap~ <br /> (j), the.~ no blood sample shall be taken eve~ though <br /> ne may vhereafter request se~me. <br /> (d) Only a p~hysician~ registered professional <br />nurse, graduate laboratory tecb~ician or a technician <br />or nu~rse designated by order of a co~ of record act- <br />ing ~Don the reco~m~endation of a licensed physician~ <br />usi~g soap and waver to cleanse the Dart of the body <br />from which the blood is taken snd using instruments <br />sterilized by the accepted s~e~m s~erilizer or some <br />other sterilizer ~ich will not affect the accuracy of <br />the test, or using che~mZcally clean sterile disposable <br />syrir~es, shall withdraw blood for the purpose of deter- <br />~ihirg the alcoholic convent thereof. <br /> (di) Portions of the blood ss~ole so withdrawal3 <br />shall be placed in each of ~wo vials provided by the <br />Chief Medical Exsminer, which ~ials shall be sealed <br />and labeled by the person t~ctng thesample or a~ his <br />direction, showing on each the .name of the accused, <br />the r~me of the person taking the blood sampte~ and <br />the date and time the blood s&~,~pie was takeao ~e <br />vials shall be placed in two containers provided by <br />the Ciqief Medical Ex~. er, which convalners shall be <br /> <br />18 <br /> <br /> <br />
