AN ORDINANCE TO PROVIDE FOR ~ ACQUISITION OF CERT~N PROPERTY~ BY ~Y~ <br />CITY OF PORTSMOUt~ UNDER F~MIl~h~ D~AIN PRO~.DiNGS Pb~SU~ TO C~iAPTW~R <br />126 OF THE ACTS OF ASSF~BLY OF 1964~ SAID PROPERTY BEING NECESSARY FOR <br />USE AS A PUBLIC STBEET. <br /> <br /> WHEEE~, the City of Portsmouth has found it to 'se necessary' to <br />acquire the fee simple title in and to the hereinafter described parcels <br />of land situate in the City of Portsmouth, Virginia, For use as a public <br />street; and <br /> <br /> krHEREAS, the City of Portsmouth has not been able to purchase certain <br />property necessary to this project because the owners thereof and the City <br />have not been able to agree upon the price to be paid therefor; and <br /> <br /> WHEREAS, advancement of the work vrill be delayed unreasonably if the <br />said property is not made ava~ao=~ as soon as possible. <br /> <br /> NOW, ~qEEEFOEE, be it ordained by the Council of tlne City of-Portsmouth, <br />Virginia: <br /> <br />Section 1. The City Attorney is direczed to institute eminent <br />domain proceedings, employip~; counsel for that .purpose agair~t <br />the property hereinafter described located ir. Pmnners Point, for <br />the purpose of acq~Airing 'she fee simple interest therein, in <br />accordance with a~d ptu~sumqZ to Section 23-f of the Charter of <br />the City of Ports~.~uth (Chapter 126 of the Acts of Assembly of <br />1964), and to deposit to'~J~e credit of the co-~ as provided by <br />law the sums specified to cmmpensate ~he respective oYmers of the <br />various parcels of land: <br /> <br />A Southern Railway uomp~u~, S ~,824.00 <br /> <br />B Atlantic Coast LAne Raz=~oam Company <br /> <br />340.00 <br /> <br />C Elizabeth River Ttmnel District <br /> <br />$ 320.00 <br /> <br />D Atlantic Coast Line Railroad Company $16,400.00 <br /> <br />Sectio~ 2.
